Huckabee Reaffirms Birthright Citizenship

The Huckster got a temporary bump on immigration enforcement the other day when he appeared to claim he would end the travesty of birthright citizenship, which allows anyone who can make it across the US border to have a child who will be recognized as a US citizen.

Shortly thereafter, Huck retracted:

“I do not support an amendment to the Constitution that would prevent children born in the U.S. to illegal aliens from automatically becoming American citizens. I have no intention of supporting a constitutional amendment to deny birthright citizenship,” Mr. Huckabee said in a statement posted on his campaign Web site.

“Birthright citizenship” is one of the most egregious examples of U.S. legislation gone awry. This provision of the US code was not meant to allow foreigners to skip across the border and have babies who would be immediately recognized as US citizens. Any country who did such a thing would have been categorized as insane.

Huckabee, in supporting such a terrible policy, lines up with the enemies of US citizens.

ok here’s the thing, it’s very irresponsible to run around amending the constitution and if you took away birthright citizenship whats to say your newborn son wouldnt be allowed to be an american citizen? what we do now will have eternal repercussions

Like most other countries, America demands you pick a nationality when a child of American citizens is born in another country. We don’t allow dual citizenship. This decision is made at the age of 18. Until then, you are your parents child and of THEIR nationality. Simple enough.

Illegals drop a baby and all of a sudden BOOM, they get welfare, food stamps, SSI, etc. and possibly get to apply and stay here.

There is no reason for birthright citizenship for the children of Illegal Aliens other than benefits. The diplomats are excluded from it and so should anyone else not here legally.

We also have a problem with Legal residents who over stay their visas and become Illegal.

We are one of the few countries that does not have restrictions and it is abused thousands of times each day.

The only way to control it is that the Mother must be a Citizen, Not the Father, the Mother, as a woman can say anyone is the father and the government can’t begin to fill the courts with DNA tests.

The Birthright Citizenship was meant for the children of the Slaves to legalize them, not every pregnant woman that stumbles over the borders for the perks and benefits.

If we change it the influx will drop like flies.
There are Illegals getting government checks for $3,500. or more a month because of their kids dropped here.

Act is saying that having a child should not be a means of circumventing the law. Especially when the child then gets all kinds of goodies on the publics dime.

I worked long enough in benefits to be able to tell you that what you have written is false. A nonlegal parent of a US citizen child could not hope to get his/her status adjusted until that child reaches 18 – and even then it is quite a process. In addition, children cannot get food stamps. You must be 18 years of age and not only legal but have had about 4 years of permanent residency status to be eligible for benefits that include Food Stamps and TANF. The only benefit for which a child, who is a citizen but whose parents are not legal, can qualify for is Medicaid or FAMIS, if they are otherwise eligible. They could also qualify for free and reduced lunch, again, if they are otherwise eligible.

There is no real benefit to the parents of a child born here that I can think of other than that, Medicaid – if elegible, and the fact that that child can leave and return to the US freely, although not with the parents, obviously.

There are many merits to both sides of this debate that would seemingly make it unnessary to resort to misinformation. Get your facts right. I have Had Enough of ignorance.

Although you did apologize and give reason for your err, you seem to conveniently fall back on being an airhead. Sure there is no fraud or cunning with your intent?

As for what the “parents” of anchor babies don’t receive; the idea that a baby that is born in this country to non-citizens of this country; whereas that baby is given automatic citizenship-this is the problem and concern for the “bleeding hearts”. How can you break-up the family and send the parents back home? Simple. The baby is in the care of the parents and cannot fend for itself. Rather than break the law for the baby’s sake, stick by the law and send everyone back HOME! I know that seems heartless but it is the law.

I would like to enact a law that states that anyone in politics that wishes to impose socialism on the masses must first do a 10 year residency in a socialist country so as to be qualified in their persuit. Of course, that person would become ex-patriated in the process and we could deny their repatriazation at a later date. I guess I won’t get my wish just like you won’t get yours. After all, you do very well at mis-direction and mis-information.

Anyway, I am not arguing the merits of birthright citzenship. You must have misread. I am simply correcting what Had Enough wrote reagrding peopel recieve thousands of dollars a month because of their citizen children, which was false.
I have to say, I think that if undocumented immigrants(or illegal aliens, if it pleases you)are apprehended and deported, than the child should logically go with them, unless those parnest can make safe a suitable arrangements for their care here. I think that this is a risk that the parents knowingly take when they give birth to a child here knowing that they face this possiblility. I am big on personal responsibilty.
Now, how I feel about how to deal with the millions of undocumented who are otherwise law abiding people in a comprehensive way is where we may differ.

Well, I think that as long as there is no record of any arrests or convictions unlawful aliens should be given the opportunity to adjust their status by paying penalties. I think that over time they should then be able to apply for residency, and then eventually citizenship, which require English profeciency and a better than avaerage undersatnding of US civics and history. I think that at the same time the border should be more strictly enforced through manpower, technology, collaboration between FBI and DEA to investigate, pursue, and prosecute human traffickers. Once this has been done there should be even stiffer penalties and better enforcement of companies that would continue to employ undocumented immigrants.
There should be more visas available for temporary workers as well – that gets tricky, admittedly.
That way you have a combination of events that would allow for more pathways for legal entry and severe discouragement from entering illegally, or bringing people through illegaly, as well as extremely decreased likelihood that employement will be readily avialable if someone could get through.

A $12,00 a year education is not a benefit ? That alone costs Loudoun taxpayers more than $25 million a year..

Someone with a visa has legal recourse when he/she is poorly treated by an employer, an illegal alien does not. Common Idiot – the penalties are fines. let’s say it costs about $4,000 to get here illegally, which is on the low side these days. They should be able to pay at least half that to adjust status, and if can be done in installments I think they will.

Dan – if you want to get technical you need to offset that cost with the taxes that are paid by illegal immigrants who work through false ss#, which is the majority, and who do not claim refunds.

Yes, there is a shortage of temp workers visas, yes there is a shortage of those willing to sponsor. I looked into it for my company and was told that construction is not one of the categories that qualify for sponsoring a worker.

All workers have some protections in the US, legal or not. For example, whether you are legal or not you have the right to get paid for work preformed.

I think you misunderstand this graet nation of opportunity if you assume that amnsety will result in a permanent underclass. People given the opportunity MOVE UP in this country. That’s teh beauty of it.

If we are talking about a permanent underclass than we are talking about continug to allow, one way or another, for 12-14 million peopel to live and work here illegally. We are also talking about a myriad of social problems. An example, my dear neice (who I adore) whose white mother had drug problems and repeatedly abandoned her, who is now 18 with 2 kids, single, with severe depression and drug problems of her own.

The revenue generated by SS mismatches is something like .01% percent of SS receivables. A very long way from the windfall that offsets public benefits. See the ss.gov web site.

The unclaimed refunds has also been debunked as not coming close to offsetting the public benefits consumed, see Robert Rector’s report.

Bottom line, illegal aliens are a significant net loss for anyone not trying to make a quick profit from their presence.

The 4th circuit has ruled that Title VII protections are not available to illegal workers. I don’t see any white single mothers or teenage parents lined up at the day labor sites, do you ?

Unfortunate situation for your niece. I sincerely hope your family is able to assist her in working through this.

Jack – My point is not the ss paid, it is that they pay local, state, federal taxes and that you simply must figure that into any financial calculation. Also pay sales tax. This is not a moral statement or a justification, it is a fact.

No, single white mothers are not lined up at day labor sites, they are lined up at the welfare office. And my niece has a big family to support her but there are thousands and thousands more like her that don’t have those support systems. You missed my point.

Jack, you missed the rest of my answer. That is part one, the second part is better border control, better investigation of and stiff consequences for coyotes, and greatly decreased opportunity for employment. It is a multifacted approach that would discouarge continued illegal immigration, and it is achievable – you must believe it possible to have better control at our borders, right?

The issue of illegals and taxes is settled.
The CBO within the last 90 days or so released a bi-partisan report de-bunking the myth that illegals pay their own way. Illegals are a net drain on the economy. Consumption taxes of 4.5 to 7 % depending on the jurisdiction don’t even scratch the surface of the overall costs.

Robert Rectors study was correct from day one.

My argument was not that the undocumented pave their own way, it is that in a good and fair analysis you need to offset what they do pay into any calculations. That’s not my point at all anyway. But G.Stone, can you send me a link to that report, please? It sounds intersting and I have not seen it.

As for overstaying Visa’s, that is referring to Tourist Visas and in that case perhaps the US should look at how many tourist Visa’s it issues and to whom. But to a certain extent my plan part #3 addresses that issue in that it would make hiring someone who can not legally work here too costly and too criminal to risk.

I do know that it is fairly common for South Americans to get Tourist Visas (from some nations more than others) and that many of them overstay their Visas, at least it was common 6 years ago when I was more involved in direct services. I am not sure how frequently this occurs with tourists from other nations. Perhaps just as often. It is worth taking a look at.

What a weird report. I could possible out report you if I cited every study, first hand account, etc that I can round up on the web in my defense.
Anyway, If that post is true then they need to get their act together in that county. If you check the VA website, and go through the eligibility you will see that you must be 18 years of age and legal to recieve most public benefits. Therefore an undocumented parent cannot collect food stamps or TANF for their citizen kids.

Anyway, I am not arguing that undocumented immigrants should recieve public benefits. I am not arguing for illegal immigration. Perhaps we are not understanding each other.

Looks to me like local governements should get some reimbursement – that is if there is no change to the current situation, which is unacceptable.

Majorie- you attribute some pretty harsh intentions on the part of undocumented immigrants. I can assure you that no one is laughing their way to the bank. Part of the problem is the personal disdain that so many people have of illegal immigrants, the assumption that they are inherently bad people who are intentionaly trying to rip us off. I don’t suspect that that is an attitude easy to change, and I do understand where it comes from. I don’t share it because I have known, worked with, and in many cases befriended hundreds of undocumented immigrants over the years. Heck, I even married one! I won’t sugar coat it either. I have also met several people who truly don’t have any respect for their neighbors, their communities, and any regret, remorse or concern that they are here illegally. I have met people who have committed crimes here, while they are here illegally. Those are the people that should be deported, without doubt, but they are the minority. I have even worked with law enforcement to get several such people turned in. Frusting thing is that they usually end up right back here.

You did hit on one important thing, which is remissions. I find that subject fascinating. But remember, what gets sent is what can be after basic expenses are paid here first. And there are even more legal immigrants that send remissions to nations all around the world. BTW, Bank of America and Western Union cater to folks sending remissions, legal or not.

One probelm with remissions is that they money doesn’t always get invested well back home. In most cases the money is used for basics, of course. I am interested in programs that encourage individual and community investment and development to improve conditions. The governements have a huge role too, mainly in providing security for their people so that those who do begin to do well can live without fear.

To the topic in general….

We did not originally have birthright citizenship. It came with the “civil war” amendments (13 – 15). My wife has a prospective on this that is somewhat worthwhile. Much of the ills we face today are because of the abuses and wrongs of the past. Racial slavery was a hideous wrong perpetrated on native Africans by their own people and those that purchased them (none of whom live today, unless we have people that are, oh, 140 years old). The SCOTUS (Dred Scott) decided that no person of African ancestry could be a citizen of the US. The highest court in this country took a whole class of people and made them sub-human from a legal standpoint.

Correcting that (and the original wrong of slavery) forced the country to widely define citizenship based on the birth of a person so individual states would not connive to perpetuate the evil they had committed. This is not to say that Africans did not participate in the evil. (It was in fact African tribes that captured other Africans and sold them into slavery). That is no excuse for those that bought slaves. It is no excuse for those that sought to dehumanize those that had been slaves.

Now that we have this broad brush fix to what had been greed in the past, it hits against a modern problem with the same force — we cannot deny citizenship of anyone born in this country. If the people of this country had self-governed and done so honorably, the need for the 14th amendment would not have arisen. The constitution we have is for a moral people. The sad truth is that most of the legal problems of today occur because of the moral failures of yesterday.

Second post here….

I fully support the deportation of someone here illegally. If they have citizen children, those children are legally citizens of this country. That is a bad situation.

An example: an illegal alien has a son and they have been here for 14 years. The father evidently was not the most savory of individuals (he was deported, and then killed in a traffic accident in Peru many years ago). The mother stays here working, is concerned about her son and wants what is best for him. If she is deported, I would fully expect her to abandon her son to the state (she recognizes the quality of life he can have here that is just not available in her home country). It is difficult to hold a job (she doesn’t have a valid SSN) and so recently was forced to resign from Costco (they received notice of the invalid SSN and demanded she either resign or provide a valid SSN as required by law — good job Costco).

The woman and her child are here “on our doorstep” so to speak. They are in desperate need (she has not paid her electric bill, and so the power company will shut off the lights in the middle of January, as is their right). What should be done? In a “just” world, there would not be a huge difference between countries that make it so much better to be here, and those that are “lucky” enough to be born here would not have such a great advantage over those born in Peru. Did I deserve the parents I had and citizenship, or was it just luck, or something else? (Something else is what I believe, but that is another story.) I’m not even sure if having the mom here and her son with her is a good thing. (Single parent mother, that is illegally here trying to give moral values to a 14-year-old son with a hypocrisy detector that will alarm at anything the mother says about right and wrong?)

Bottom line though is do you let the lights go out in January or help.

Illegals come here knowing that there is always a chance that they will be caught and deported. Their children are victims of their actions and crimes, but so are the children of our home grown criminals whose children visit them in jail and prison. Some must go on welfare after the parent in incarcerated.

Do we give the vacant or abandoned house to the family of squatters? No.

Most of the kids born to illegals are dual citizens. Mexico changed their constitution to make sure that the kids born to Mexicans no matter where they live in the world are Mexican Citizens. As there president recently said “wherever there is a Mexican, there is Mexico.”

I once lived next door to a Diplomat family from Peru, their kids born here were not citizens and when their time here was up, they went home with their teenage children to Peru.

Sorry, but no they can’t stay.

Some illegals are leaving their countries and when they get here they marry someone else not giving a second thought to the family they left at home.

I know of someone who married a illegal, he took all of her money out of the bank, charged her credit cards to the max, stole her jewelry, valuables and car and heard that he headed for home. I understand that she can not get help from anyone to charge him or otherwise.

I believe that many make a career of these things, its easier than robbing a bank and you get extra benefits.

You deserve everything you get when you also break the law to aid, abet and harbor them.

Many people could tell the same story, minus the illegal status of the spouse, and the spouse could not be criminally charged in many cases. It all depends on the exact circumstances of the alleged larceny. It could end up being declared a civil problem due to the privileges conveyed by marriage.

I believe that a lot of American women (and men to a lesser degree) make a career out of getting married as well. They’re called “gold diggers.” They might be even more prevalent than illegals here in Loudoun County. I wonder if we can convince the Board of Supervisors to deny services to gold diggers…

I admire your zeal on this topic, but I don’t think the whole “Deport ‘em all and build a wall” approach is practical. Further, scaring the illegal immigrants away from our county will further damage our housing market by increasing the supply without a comparable increase in demand.

I think folks like President Bush and Senator McCain had the right kinds of ideas. It just isn’t realistic to deport 12-14 million people. We need to facilitate more legal immigration, and use good screening methods to weed out the bad apples. When there are fewer illegal immigrants, it will be a more manageable problem, and the criminal types will be easier to identify.

So, if we passed legislation that many would view as a compromise on the issue, the number of illegals would be more manageable, therefore we could deport more of the potential killers and reduce the 9,125 figure you speak of. The other option would be to label such a proposal as “Amnesty” and argue about it a few more years.

So, apparently for you, the language barrier is a big deal. Why not create a pathway to legal residency, one of the conditions being that they have to learn English? Also, maybe if you grant them a work permit and SSN, they’ll be able to get a decent job with health insurance. Of course a lot of folks want their businesses to reap bigger profits by not offering such benefits, which may be part of the political problem right now.

Since they mostly rented homes from landlords who knowingly rented to illegals and there are sometimes 20 to 40 living ia one residence in shifts the impact will not be as bad as you would like us to believe.

Since they usually rent what we call affordable housing and the thousands of homeless just in NOVA have not been able to obtain such affordable housing it could open opportunities for many who now have regular jobs but no where to live. Could also open jobs up for those that have none.

As for the mortgage companies that encouraged Illegals to buy $6hundred to $8hundred thousand dollar homes with no documentation and arms, they deserve loose their shirts

Every Illegal who has crossed the border since 1986 has been waiting for the next Amnesty and encouraging their family and friends to also jump the border. I read an article about a illegal in CA who tells all the Illegals just to sit tight that there WILL be another Amnesty.

Everywhere that there has been a crackdown, they have for the most part left. ATTRITION is the word. Make them uncomfortable and take away all the freebies and perks, they will leave.

I have too many friends in construction that go from job site to job site seeking work and they are never hired. The workers are all mostly Hispanic. A worker on a site told a friend as they were leaving a site that their boss told him that “why should I hire him when I can get 3 or 4 Mexicans for the price of ONE American, even if they screw the job up and it has to been done twice, I’m still ahead.”

Everyone is not a scientist, teacher or doctor, schools have always encouraged talented students to learn the trades. There was always someone for every type of job, now there are trades being eliminated for the American worker and they are only open for the cheap labor. These were decent paying middle class jobs, they are what made this country what is was, and I mean WAS.

The housing industry is so saturated with Illegals in all the trades, there is not even enough work for THEM. And with unemployment at 5% (actually it is much higher) and the housing slump it is time for them to leave and put the Citizen workers back to work.

There are many in Loudoun who had respectable careers in the industry who have been pushed aside. Where are the kids at Monroe Tech going to get a job? Nowhere! unless they are willing to work for $7.00 an hour. These kids have talent and want to display it with their hands.

So the experienced get pushed aside for the cheap that has to do the work over and over, but the boss still makes a profit.

There is still a US Citizen for every job in this country, but they need a decent wage. The stockholders will just have to receive less.

4. I don’t hear you complaining about our soldiers sleeping in tents all over the world protecting us. No one complained when my grandfather slept in a tent outside in below freezing weather overseas during WWII.

5. Up near Seattle there is large tent city of homeless citizens. The main concern about the tent city (which almost all of them work) by town officials is the appearance and how it looks.

No minds will be changed but after reading through this thread since I last left it I can correct a few errors. The most glaring is the presumption that the US is the only nation that is dealing with illegal immigration. It is actually a very widespread problem wherever there are relatively stable nations in close proximity to impoverished and/or war torn nations.

There are several nations that are having a tremendous time dealing with exiles and refugees from Iraq, as an example. Spain, England, Germany, France, they are all dealing with these issues and there is similar fear among some of their citizens regarding Islam, and other languages, ethnicities, etc. It is really interesting to following world news to see how this is playing out across the globe. It is, of course, and ancient dilemma. Eastern European nations, Africa, Asia.

Wherever there have been sovereign nations that prosper there have been impoverished and suffering masses seeking refuge and opportunity. In almost every instance there is a segment of the native population who views this as a unique threat that will lead to the downfall of the civilization. I believe there may be a few examples in the bible.

The second glaring error is the assumption that anyone who supports immigration reform with some kind of amnesty is a liberal. I am not a liberal, certainly not far right, but not a liberal. McCain certainly is not. Check out the votes. Nothing significant has passed but there has been bipartisan support on many of these bills.

Laura, Thanks for bringing in the international view, but I have to say I think that argument favors our side more than yours. Many of those countries do have major problems, at least in cases where the minority population is refusing to assimilate into the predominate culture.

And re: the stereotyping as liberal, that goes both ways. Not everyone who supports immigration reform without amnesty is conservative. That crosses both sides of the aisle as well. Speaking of the problems overseas, look at the French. One of the most liberal societies around and they recently elected one of the outspoken anti-illegal immigration candidates in the world. (Wow, never thought I’d use the French as an example of something to emulate. Will wonders never cease?)

We already try to give criminals every reasonable chance to avoid jail time. If you don’t believe me, spend a day at the courthouse in Leesburg. Those that ultimately end up in jail are typically the most deserving.

Comparing criminals being sent to jail with the prospect of 12-14 million illegal immigrants is improper. The difference is that the illegal immigrants would be a sudden and huge segment of the population trying to leave, while the number of criminals going to jail has been relatively constant over the years. There is no proposal of any increase to the number of criminals going to jail, but you are proposing an increase in deportations — and thus an increase in properties going up for sale.

Still waiting to hear who’s going to finance the hunting-down and deportation of millions of illegal immigrants under the HSL plan.

The single thing that would shut down illegal immigration, and shut it down quickly, would be workplace identification enforcement. If a company had a short, computerized system to verify the identity of a worker as valid (computer checks could take minutes) and serious consequences for employers that do not process employees in a timely and correct manner, the problem would end. If the fines for an employer were on the order of $10000/day for hiring an illegal alien unless specific steps were taken and verified, businesses would instantly become much more concerned about hiring only those persons that are legally allowed to work.

Cut off the reasons for coming here, and the flood will subside quickly.

The old canard of hunting down however many millions of illegals is a fiction. The reason they came here was economic. If we make it hideously expensive for employers to hire the illegals then guess what? They won’t get hired and then will leave. Think $10K fines for each illegal caught working on the sight. One per week per locality would do wonders.

Enforcement through attrition will add some impetuous to the outflow. For each illegal caught, jailed and then deported many others will get message and leave on their own. It took about 30 years of willful neglect to get to this point. So if it takes a few to alleviate it, that is fine with me. The point is, we don’t need to conduct roundups.

As for the housing market, typically illegals pack about 15 to 25 adults into a dwelling the that normally would have 1 to 3. If the slum lords who thumb their noses at the communities they rent in get hurt, I am NOT crying.

I married a man who at the time was undocumented. That is how I, in retrospect would phrase it. Technically it could be said that I married an illegal alien (is that how DHS defines it?). I would never say I married an illegal. That is an abuse of the Engslih language.

The rest of your post doesn’t warrent a response because its is too far out for me.

Linda, refreshing intellect as usual, even though I disagree. I think the verdict is still out in Europe and it is very complex from nation to nation. Some nations have been very successful in integarting immigarnst and have littel problem with illegal immigrants because tehir immigration systems are more friendly. I would assume that you would view the sitution with the same perspective that you view the situation here, as do I.

I will say that integration and assimilation is critical and a culture/religion that DELIBERATELY resists that process when its people move to other regions is bound to create trouble. We probably can at least agree on that point. I also certainly agree that there are many Democrats who oppose amnesty for the undocumented, though a relatively small percentage. We both know that any solution to the problem has got to be bi-partisan, even though we obviously disagree on the solution.

If you want to create an uncomfortable environment in hopes of solving the immigration problem — I think they’re already uncomfortable, but they’re not leaving. Also, if you consider the economic impact of rendering 12 million people unemployed with their houses for sale, things could get much uglier than they are now. Besides, it wouldn’t be a very Christian way of doing things.

Marjorie- there is a subtle difference that you don’t seem to be picking up. Obviously the issue of who I married is not in question here. The way that I describe his legal ststaus at the time we married is. I woudl never describe him as being “an illegal”. You would and it is the improper use of the English language that I object to. I won’t obsess over it, but I’ll give one more attempt to clarify.

When I wrote “one” I was referring back to the subject of the previous sentence, undocumented immigrants.

That is the phrase I prefer, but I don’t object to illegal immigrant or illegal alien, or whatever DHS uses. In fact, I use those phrases and have taken a lot of heat from a lot of people and groups for doing so.

I do object to the use of “illegals” or “illegal”. ‘Illegals’ is not a real word and ‘illegal” is not a noun it is an adjective.

Regarding the 9,000 deaths that were associated with illegal immigrants: I strongly support the deportation of any illegal immigrant that has demonstrated behavior that is indicative of being a danger to society. I say let’s identify members of this subset of illegal immigrants through a screening process that would occur when they apply to be permanent residents.

Also, you say that doing the right thing as a Christian is a “cop out…” For you, does the same rule apply to other political issues such as abortion?

You are supposing that they ever DO apply for permanent status. How about let’s stop them at the border and find out who they are and what they may be carring? First off, I agree with securing the border — if anyone disagrees with this they are definitely a small minority.

I’m on crack? You guys suggest that numerous people have been killed by illegal immigrants. If they lack a conscience as you guys suggest — when you take away their means to make money peacefully, aren’t you worried about increases in robberies — and increased drunk driving and drug use due to the stress of the new hardships that you want to impose on them?

I believe that most undocumented workers would apply for residency if there was a feasible path for them. This would reduce the number of illegals to a more manageable number for ICE to deal with. Further, if legal status is possible for largely peaceful hard-working immigrants, it would leave mostly the criminal element as illegals — making it easier to identify and deal with the criminal element.

A lot of you are concerned about undocumented people not speaking English. How many of you have invested a significant amount of your time teaching ESL in the community? That would be one positive way of addressing your concerns — helping your neighbor, it’s the Christian way.
