On the Supreme Court, you never know what the affects of a new justice will be on the Court. Even though the mix will not necessarily change with an Obama pick, the swing vote – Justice Kennedy – may be persuaded (on votes and opinions) by another liberal voice. Let’s face it, the other 3 are pretty stale (Souter, Ginsberg and Stevens), so if you get a young, energetic, Liberal Justice appointed by Obama – Kennedy could be influenced. Not to mention that age is a factor, look at John Roberts – he has the potential to serve for 30 plus years. We could have 3 young liberals that would be around for 3, possibly 4, decades with Obama.

All said, it is a serious problem. We get 1-2 good picks through with McCain – we are good for another decade.

Hillary can still get in if 0bama wins but is declared incapable of serving before the Electoral College votes. Then, they can elect Hillary instead!

NEWS FLASH: Hillary wants McCain to win. Seriously, didn’t you see the DNC pry the nomination out of her hands? She still feels robbed (and she was too). Here’s the deal: the neo-dems are the party of selfishness and this is why Obama is going to lose. The Hillary voters have taken this personally and are not voting for Obama despite him having the same ideas as Hillary. Party unity my a$$ remember? They’d rather have McCain win and “make a statement” than watch Obama take something “meant” for Hillary.

Make no mistake, Hillary is banking on it too. She wants to be the first woman president and she’s going to make it happen in 2012. She’s down now, but watch her “I told you so” coming in November.

If Obama hates Hilly, and she doesn’t have a chance of getting an appointment anywhere in his administration, why isn’t she actively swaying votes to McCain? Especially those Hilly voters who still hold aligience to her? Probably because DEMOCRATS for the most part follow party-not the candidate. Although there are some GOP’ers that do the same, you can see from this site it is SUBSTANCE-not party. Libs hate giving up all those free beans regardless of all the in-fighting they do amongst themselves. You agree?

I don’t know what the hell Zimzo’s point is so I will attempt to steer the discussion back in the direction of relevance.

The most likely next justices to retire will be Souter (because he wants out), and Ginsburg and Stevens (because of age). All “liberal”.

Even if the next president gets to replace all three of them, and replaces them all with liberals, it will not change the ideological balance of the Court one iota.

I agree the judicial appointment issue is an important reason to support John McCain, but I don’t think the prospect of Justice Hillary Clinton is necessarily a game changer. I think the possibility of replacing a liberal with a conservative is the more important consideration: Not electing John McCain has an opportunity cost vis a vis the Court.

Obama hates Hillary. of course, two of the most liberal members of the court, Souter and Stevens were picked by Republicans and McCain was a member of the group of congressmen that forged a compromise and repudiated the most conservative court choices of President Bush. Plus a President McCain will have to get his choice through a Democratic Congress. So I am confident that McCain will select moderate judges who will not overturn Roe v. Wade. Really, you guys are screwed either way.
