The Judicial Oath

The following is the oath a justice must pledge before taking a seat on the federal bench:
“I, __________, do solemnly swear (or affirm) that I will administer justice without respect to persons, and do equal right to the poor and to the rich, and that I will faithfully and impartially discharge and perform all the duties incumbent upon me as (name of position) under the Constitution and laws of the United States. So help me God.”
So, how does this square with Sotomayor’s own statements(see below)?
“[W]e who judge must not deny the differences resulting from experience or heritage but attempt . . . continuously to judge when those opinions, sympathies, and prejudices are appropriate.”
So a prejudiced judge is okey-dokey if they are Spanish? Or does this extend to all of the ‘oppressed’ classes? This is lunacy. Sotomayor has other statements regarding Judicial activism with regard to where federal policy is set — in the appellate courts! She also believes that latina woman is inherently a better judge than a white male. This is both sexist and racist. This is also Obama’s first pick to the Supreme court. There must be someone better out there. Is there a liberal judge with gravitas in the house?

Jacob,
Are you that naive my boy? The problem with ANY court is the possibility-nay, the PROBABILITY that ajudication will derive from the judges’ activism (or fuzzy sense of feeling) is far greater than half. Our living Constitution tells us that we need to change with the times and that is the time honored duty of the court to determine where the Constitution is at any specific place, time or event. And when these laws are made from the bench and you have lost all cognizant sight of that bland, faded piece of parchment, you will begin to understand what it is to be a “world citizen”. After all, the framers never intended this experiment to last as long as it did. They knew that apathy and liberal idiots would eventually screw it up. Voila!
As a note: I find it very disturbing that I always hear about “..seperation of church and state..” with just about everything BUT I NEVER HEAR about seperation of branches and powers from those same individuals. This is how we disect and pick-and-choose those sections that “fit” our arguement. Only problem is that the Constitution is an all or nothing agreement.

I’m gonna be sick. “Bumbling Bob” Gibbs is out there literally warning all of us to go easy on Sotomayor. Up pop those Republican paragons of courage Cornyn and Hatch to wag their fingers at Conservative critics of the Sotomayor nomination. And Peggy Noonan? Well, she appears to be ready to roll over and enjoy it. Honest to God, these people on the Hill and those who flout their past history as Republicans are pieces of work. Slap them in the face, and they recommend counterattacking with a feather. This country does so need a top-to-bottom cleaning, starting with that garbage pit on Capitol Hill.

I gave up on Peggy long ago, she is member of the media elite and afraid she will not get invited to the next wine and cheese party at the NYT’s exec’s house. It’s sad because she is a gifted writer.

Senate claiming no public outrage on Sotomayor.
Either they are lying or people are giving up hope on this nation.
The hearings were a sick pandering joke, she did not answer one question without spinning and batting her eyes so fast that I thought she would take flight any second.
Her nervousness and untruthfulness showed in her body language and constant excessive batting of her eyes on the same repeated racial questions which I believe was a sign of lying.
Every school she attended was a Private School, her family did not always live in the “Projects,” she lived in middle class neighborhoods. She strays, she decides on her pesonal opinions and has shown that she is in fact, racist.
Sonya Sotomayor, served on the National Council of La Raza from 1998 to 2004 – beginning her involvement one year after the president of Mexico stood before the group and declared that “…the Mexican nation extends beyond the territory enclosed by its borders and that Mexican migrants are an important, a very important part of it.”
Jose Angle Gutierrez, founder of the La Raza Unida Party, “We have got to eliminate the gringo, and what I mean by that is if the worst comes to the worst, we have got to kill him.”
She is nothing more than another Aztlan member.
