INTENT IS NOT A GRAY AREA. Either the gun is pointed at you, or it’s not.
The simple possession of the firearm is called opportunity.
When it’s pointed at a living being, that is the intent.

Let’s recap, to accomodate for your slow wit.
If the perp has used the firearm to deliver the round to your ass, and then turns and runs away (with the firearm still in his possession) the threat has passed and his intent dissappeared with it. You may not use deadly force at that point. Those are the facts and the drill of dealy force. Every responsible and sane firearm owner knows these as second nature.

Inform your ignorance by attending such training, and you’ll stop this liberal and uninformed drivel.

The gray area is intent. You rarely know intent since no one is a mind reader. The possession of a gun in your hand is some indication of intent to use it but maybe not against me?

Please answer the question from the perspective of one of the 9 people behind the planter in NYC and assume Virginia gun laws.

I know i would have retreated and called for backup but in previous discussions that was ridiculed so I want to hear about better solutions for this real life situation.

This is a multiplied answer, Ed.
If the person who shot you is in retreat…then the answer is no.
If the person who shot you has demonstrated his/her intent to fire again….then drop them.
The rules of the escalation of deadly force are EXACT and there is no gray area.

Identified, sue them…anything less and protect yourself.
Ed… If the problem maker has a gun in hand, his opportunity is present. If it’s pointed AT you, he’s just signalled his INTENT. Drop him like he’s hot.
Responsible gun owners are schooled in the escalation of deadly force. There is no “wild west mentality” among responsible owners.

IF either of three significant points is diminished (mostly the latter two, which are opportunity and intent) are removed from the equation, the answer is “don’t shoot”.

If all three elements are present and the instigator could well kill or maim (signalled by a present opportunity and FULL INTENT) he’s history.

Seems that Biden will be a no-show in Tampa. Liberal lovers are happy the RNC has to deal with a hurricane. Liberals will condemn the GOP for going forward with their convention, being the heartless people they are, while people contend with tradjedy. Obama will make a statement for Romney to put his campaign on hold while trying to unite the nation in the wake of Issac–but only after it hits since Barry has some prime campaigning spots to make.

If I have a gun and I just took a frag to the buttocks, can I legally shoot back in self defense? What if the shooter is dressed in a uniform or a suit and therefore might be LE? What if they actually are LE? And if my return fire misses the target and hits someone else, can that person start shooting too? How does this mess end..when everyone runs out of ammo?

I’m curious how those who frequently carry guns plan to handle situations like this. How do you communicate to the public that you are defending yourself as opposed to being a bad guy.

Perhaps the prohibition on guns in a high density areas is protection for the police from citizens who might otherwise engage in self defense.

One of the initial reports I heard said that the perp’s gun jammed on him. Aside from that, I cannot believe that the pointman and his backup approached so close together when they had a report of a shooter who had already downed someone. If the report on the jamming is true, and watching the reaction of the two officers when the perp drew, I would say both those boys in blue were lucky not to be on the casualty list themselves. Looked to me like an instant adrenalin rush causing an O.K. Corral scenario at close range.
