The simple possession of the firearm is called opportunity.
When it&#039;s pointed at a living being, that is the intent.

Let&#039;s recap, to accomodate for your slow wit.
If the perp has used the firearm to deliver the round to your ass, and then turns and runs away (with the firearm still in his possession) the threat has passed and his intent dissappeared with it. You may not use deadly force at that point. Those are the facts and the drill of dealy force. Every responsible and sane firearm owner knows these as second nature.

Inform your ignorance by attending such training, and you&#039;ll stop this liberal and uninformed drivel.</description>

Aside from that, I cannot believe that the pointman and his backup approached so close together when they had a report of a shooter who had already downed someone.  If the report on the jamming is true, and watching the reaction of the two officers when the perp drew, I would say both those boys in blue were lucky not to be on the casualty list themselves.  Looked to me like an instant adrenalin rush causing an O.K. Corral scenario at close range.</description>
